Terms of  Service

1. Interpretation and Definitions
Interpretation​

Words with initial capital letters have specific meanings defined below. These definitions apply whether they appear in singular or plural form.

Definitions​

  • Application: The software provided by the Company and installed on any device, known as Home Decor AI.

  • Application Store: The digital marketplace operated by Apple Inc. for distributing applications.

  • Affiliate: Any entity controlling, controlled by, or under common control with another, where control means ownership of at least 50% of voting shares or interests.

  • Company (referred to as “We,” “Us,” or “Our”): Xygen Tech Limited, the owner and operator of the Service.

  • Free Trial refers to a limited time period that may be offered at no cost when subscribing to a service.

  • In-app Purchase refers to the purchase of products, services, or subscriptions made through the Application, subject to these Terms and the Application Store’s policies.

  • Subscriptions refer to the services or access provided by the Company on a recurring payment basis.

  • Device: Any hardware capable of accessing the Service, such as smartphones or tablets.

  • Service: The Application and all associated features, functionality, and content.

  • You: The individual or entity accessing or using the Service.

2. Acknowledgment

These Terms, along with our Privacy Policy, form the entire agreement between You and the Company. By using the Service, You agree to these Terms and confirm that You are at least eighteen (18) years old. If You disagree with any part, stop using the Service immediately. Please review our Privacy Policy to understand how we handle your personal data.

3.Subscriptions
Subscription Period​

Certain features of the Service are only accessible through a paid Subscription. Subscriptions are billed in advance on a recurring basis (e.g., daily, weekly, monthly, or annually), depending on the plan chosen during purchase. At the end of each subscription term, it will automatically renew under the same conditions unless You or the Company cancels it.

 

Subscription Cancellations​

You can cancel your Subscription renewal through your Account settings or by contacting the Company. No refunds will be provided for the fees already paid for the current period, but You will continue to have access to the Service until the end of the Subscription term. If purchased via an In-app Purchase, cancellations must be done through the Application Store.

 

Billing​

If automatic billing fails for any reason, the Company will send an invoice for manual payment within a specified timeframe. For In-app Purchases, billing is managed by the Application Store, which follows its own terms and conditions.

 

Fee Changes​

The Company reserves the right to change Subscription fees at any time. Any fee adjustments will take effect at the end of the current billing cycle, with prior notice given to You. Continued use of the Service after fee changes signifies Your acceptance of the new rates.

 

Refunds​

Except as required by law, Subscription fees are non-refundable. Refund requests may be reviewed on a case-by-case basis at the discretion of the Company. For In-app Purchases, refund policies are governed by the Application Store, and You should contact them directly for such requests.

 

Free Trial​

The Company may offer a Free Trial for a limited period. You may be required to provide billing information to sign up. No charges will be applied until the Free Trial ends. At the trial’s expiration, unless canceled, You will be automatically billed for the selected Subscription plan. The Company reserves the right to modify or cancel the Free Trial at any time without prior notice.

4.Intellectual Property

All content, features, and designs within the Service are the exclusive property of the Company or its licensors, protected by copyright and trademark laws. Unauthorized use, reproduction, or distribution of materials is strictly prohibited.

5.Links to Third-Party Websites

The Service may contain links to external websites. We are not responsible for their content, practices, or any resulting damages. Please review their terms and privacy policies before use.

6. Termination

We may terminate or suspend Your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions.

Upon termination, Your right to use the Service will cease immediately.

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of this Terms), even if the Company or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.


Some states do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, which means that some of the above limitations may not apply. In these states, each party's liability will be limited to the greatest extent permitted by law.

8. “AS IS” Disclaimer

The Service is provided “as is” and “as available”, without any warranties of any kind. We make no promises that the Service will always be error-free, uninterrupted, or meet every user’s expectation. While we strive to maintain reliability and security, we cannot guarantee the absence of technical issues, interruptions, or harmful components.


Some laws may give you rights that this disclaimer cannot limit, and in such cases, those rights will remain fully protected under applicable law.

9. Governing Law and Dispute Resolution

These Terms are governed by the laws of the applicable jurisdiction, excluding conflict-of-law principles. You agree to attempt informal resolution of any disputes before initiating legal action.

10. Regional Compliance

  • EU Users: Mandatory consumer protection laws of your country apply.

  • U.S. Government Users: The Service qualifies as “Commercial Computer Software” under 48 C.F.R. § 2.101.

  • U.S. Export Compliance: You confirm You are not in a sanctioned country or listed on any U.S. prohibited parties list.

11. Severability and Waiver

If any provision is deemed invalid, it will be modified to remain enforceable. Failure to enforce a right does not waive it.

12. Translation

If translated, the English version will prevail in the event of inconsistencies.

13. Changes to These Terms

We may revise these Terms periodically. Material updates will be communicated at least thirty (30) days before taking effect. Continued use of the Service means You accept the updated Terms.
